By accessing and using Globie, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
Globie is an interactive 3D globe platform that allows users to drop pins on a map and share messages with a global community. The service is provided "as is" and may be modified or discontinued at any time.
You are solely responsible for the content you generate and the coordinates you choose to make public. You strictly agree not to:
You retain ownership of content you post on Globie. By posting content, you grant us a non-exclusive, worldwide license to display and distribute your content on our platform. All rights in the Globie platform, including software, design, trademarks, graphics, and interfaces, remain the exclusive property of Globie or its licensors. For special or featured pins, visibility, ranking, and persistence may change and are not guaranteed; Globie does not promise traffic, results, or specific attention. We reserve the right to remove any content that violates these terms.
We may suspend or terminate your account for violations of these Terms, legal obligations, security needs, abuse prevention, or other reasonable reasons related to the proper functioning of the platform. You may delete your account at any time through the settings page. Deleting your account permanently and irreversibly removes all pins published by the user, which will no longer be visible on the map to any other user. Data we are required to retain for legal obligations (e.g. billing data) is excepted.
Globie is provided "as is" without warranties of any kind. We do not guarantee continuous or uninterrupted service availability. We are not liable for user-generated content or any damages resulting from use of the service.
We may update these terms at any time. Continued use of Globie after changes constitutes acceptance of the new terms.

These Terms are governed by Italian law and European Union regulations. For users qualifying as consumers under applicable law, the mandatory jurisdiction of the consumer's place of residence or domicile remains unaffected where required by law. For all other users, any dispute arising from these terms shall be subject to the exclusive jurisdiction of the Court of Milan, Italy.
In no event shall Globie, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the service. Globie's maximum liability is limited to the total amount paid by the user in the 12 months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Globie and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these terms, misuse of the service, or violation of third-party rights.
We shall not be liable for delays or failure to perform our obligations caused by events beyond our reasonable control, including but not limited to: natural disasters, wars, terrorism, pandemics, third-party service interruptions, network or infrastructure failures.
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Globie regarding the use of the service and supersede all prior or contemporaneous agreements.
Pursuant to Article 14 of Regulation (EU) No. 524/2013 on Online Dispute Resolution (ODR), we inform consumer users residing in the European Union that the European Commission has established an online platform for the out-of-court resolution of disputes, accessible at https://ec.europa.eu/consumers/odr/. Under Articles 52 et seq. of the Italian Consumer Code (Legislative Decree 206/2005, implementing Directive 2011/83/EU), consumers have the right to withdraw from distance contracts within 14 days of conclusion. However, in accordance with Article 59(1)(o) of the Consumer Code and Directive (EU) 2019/770, the right of withdrawal is EXCLUDED for the supply of digital content and digital services (including pin placement on the globe) when performance has begun with your express agreement and acknowledgment that you will lose the right to withdraw. By proceeding to payment, you: (i) expressly request immediate performance of the digital service; (ii) acknowledge that you forfeit the right of withdrawal once payment is confirmed.
For users qualifying as "consumers" pursuant to Article 3 of the Italian Consumer Code, all mandatory rights recognized by European legislation (Directive 2011/83/EU on consumer rights, Directive (EU) 2019/770 on digital content and services) and by the Italian Consumer Code remain unaffected. No provision of these Terms may be interpreted in a manner detrimental to such mandatory rights.
Reports and abuse cases are assessed based on severity, frequency, intent, risk to users or third parties, prior warnings, and platform-protection needs. Possible measures include warnings, removal of content or pins, feature limits, temporary suspension, and permanent bans in serious or repeated cases. Urgent action may be taken for unlawful content, fraud, mass spam, security risks, or manifest breaches. Where reasonably possible, users may request review by writing to legal@globie.org.
